Welcome to Wasatch Comic Con. These Terms & Conditions (“Terms”) govern your use of the Wasatch Comic Con website located at wasatchcon.com (the “Website”) and your participation in Wasatch Comic Con and related activities (the “Event”).

By accessing the Website, submitting an application, registering for or participating in the Event, or otherwise interacting with Wasatch Comic Con, you agree to these Terms, as well as any additional rules or policies applicable to particular activities.

If you do not agree to these Terms, please do not use the Website or participate in the Event.

1. About Wasatch Comic Con

Wasatch Comic Con is a creator-focused comic convention established in 2018 and operated by The Nerd Store. The Event is intended to provide a welcoming, family-friendly environment where fans can interact with comic creators, artists, vendors, guests, and other members of the community.

Wasatch Comic Con may be held at Valley Fair Mall in West Valley City, Utah, or at another venue designated by the organizers.

2. Changes to the Event

Wasatch Comic Con reserves the right to change, modify, postpone, relocate, or cancel any portion of the Event, including:

  • Event dates and times;

  • Venue or location;

  • Guests and performers;

  • Panels, workshops, programming, and activities;

  • Vendors and exhibitors;

  • Event policies and procedures.

Guest appearances, schedules, programming, and other Event details are subject to change without notice.

Wasatch Comic Con will make reasonable efforts to communicate significant changes through the Website, email, social media, or other appropriate channels.

3. Website Use

You agree to use the Website only for lawful purposes.

You may not:

  • Use the Website to engage in unlawful activity;

  • Attempt to gain unauthorized access to the Website or its systems;

  • Interfere with the Website's operation or security;

  • Upload malicious code or harmful material;

  • Submit false, misleading, fraudulent, or impersonated information;

  • Use automated systems to improperly collect information from the Website;

  • Violate the rights of Wasatch Comic Con, its organizers, guests, vendors, sponsors, partners, or other individuals.

We reserve the right to restrict or terminate access to the Website when we reasonably believe these Terms have been violated.

4. Event Admission and Participation

Unless otherwise stated, general admission to Wasatch Comic Con is free.

Attendance and participation are subject to venue capacity, security requirements, Event rules, and the direction of Wasatch Comic Con staff, volunteers, security personnel, and venue personnel.

We reserve the right to refuse admission to or remove any person whose conduct violates these Terms, the Code of Conduct, venue rules, applicable law, or the safety and well-being of others.

No refund or compensation will be provided for removal from the Event due to a violation of Event rules.

5. Code of Conduct

Wasatch Comic Con is a family-friendly event and expects attendees, guests, vendors, volunteers, staff, and other participants to behave respectfully.

Harassment, discrimination, threats, intimidation, sexual harassment, or conduct that makes another person feel unsafe or unwelcome is not tolerated.

Cosplay does not constitute consent to photography, touching, sexual comments, or other unwanted interaction.

Attendees are also expected to respect the rules and property of the Event venue.

The complete Wasatch Comic Con Code of Conduct and Cosplay Rules may impose additional requirements, including rules concerning costumes, props, weapons, masks, and conduct.

In the event of a conflict between these Terms and a specific Event policy, the more specific Event policy may control for that particular activity.

6. Cosplay, Props, and Weapons

All cosplay and costumes must comply with Event and venue requirements.

Weapons, props, replicas, and other potentially dangerous items may be subject to inspection, restriction, or prohibition.

Wasatch Comic Con currently requires weapons to be checked upon entry and prohibits guns or facsimiles of guns. Weapons made of metal or other hard materials capable of causing injury are also prohibited.

Wasatch Comic Con reserves the right to determine whether a costume, prop, weapon, accessory, or other item is permitted.

Failure to comply may result in confiscation of the item, removal from the Event, or other appropriate action.

All cosplay and costumes must comply with Event and venue requirements.

7. Vendors, Artists, and Exhibitors

Vendors, artists, exhibitors, and other sellers must comply with the applicable Wasatch Comic Con Vendor Rules & Agreement in addition to these Terms.

Vendor participation is subject to acceptance by Wasatch Comic Con and availability of booth space. Booth fees, payment requirements, setup procedures, refunds, power requirements, content restrictions, security provisions, and other vendor requirements are governed by the Vendor Rules & Agreement.

Vendors are responsible for:

  • Their own merchandise and property;

  • Their own sales transactions;

  • Applicable taxes and licenses;

  • Compliance with applicable laws;

  • Their own return and refund policies;

  • The conduct of themselves and anyone working at their booth.

Wasatch Comic Con is not a party to transactions between vendors and their customers.

8. Vendor Content

Wasatch Comic Con is a family-friendly event. Vendors and exhibitors are responsible for ensuring that their displays, merchandise, artwork, signage, and other materials comply with Event standards.

NSFW material must be appropriately censored. Wasatch Comic Con reserves the right to require material that it considers inappropriate for the Event or venue to be covered, removed, or otherwise modified.

Failure to comply may result in removal from the Event without a refund.

Wasatch Comic Con also maintains restrictions on AI-generated artwork displayed or sold by vendors, as described in its Vendor Rules & Agreement.

9. Applications

Wasatch Comic Con may offer applications for vendors, sponsors, programming participants, volunteers, creators, and other Event participants.

Submitting an application does not guarantee acceptance.

Wasatch Comic Con reserves the right to approve or decline applications at its discretion and may impose additional requirements or conditions on participation.

Applicants are responsible for providing accurate and complete information.

10. Payments and Refunds

Certain Event-related products, services, booth spaces, sponsorships, or other opportunities may require payment.

Payment terms, deposits, fees, and refund policies may vary depending on the particular offering and will be communicated as part of the applicable agreement or application.

For vendor booth spaces, the applicable Vendor Rules & Agreement establishes the governing payment and refund requirements.

Unless a written policy specifically provides otherwise, payments are not refundable merely because a participant changes their mind, fails to attend, or is removed from the Event for violating Event rules.

11. Event Cancellation or Postponement

Wasatch Comic Con may cancel, postpone, relocate, or modify the Event due to circumstances including, but not limited to:

  • Severe weather;

  • Natural disasters;

  • Public health emergencies;

  • Government orders;

  • Venue issues;

  • Security concerns;

  • Labor or operational disruptions;

  • Acts of God;

  • Other circumstances beyond the reasonable control of the organizers.

If an Event is canceled, postponed, or materially changed, any refunds or credits will be determined according to the applicable Event or vendor agreement and the circumstances involved.

12. Personal Property

Attendees, vendors, guests, volunteers, and other participants are responsible for their own belongings.

Wasatch Comic Con does not guarantee the security of personal property and is not responsible for lost, stolen, damaged, or unattended belongings except to the extent liability cannot legally be excluded.

Vendors should take particular care to secure merchandise, equipment, artwork, money, and other valuable property.

The existing Vendor Rules & Agreement specifically states that Wasatch Comic Con is not responsible for lost or stolen vendor property.

13. Photography, Video, and Audio Recording

By attending Wasatch Comic Con, you acknowledge that photography, video, audio recording, livestreaming, and other forms of media may take place during the Event.

Unless otherwise prohibited or restricted by law, venue policy, or an applicable agreement, you grant Wasatch Comic Con and its authorized representatives permission to photograph, record, and use your image, likeness, voice, or appearance captured in connection with the Event for legitimate Event-related purposes, including:

  • Event promotion;

  • Advertising;

  • Social media;

  • Websites;

  • Newsletters;

  • Recaps and highlights;

  • Future Event marketing.

No compensation is owed for such use unless otherwise agreed in writing.

If you have concerns about being photographed or recorded, please notify Event staff when reasonably possible.

This provision does not override applicable privacy, publicity, or other legal rights.

14. Intellectual Property

The Wasatch Comic Con name, logos, branding, graphics, website content, original promotional materials, and other materials created by or for Wasatch Comic Con are protected by applicable intellectual property laws.

You may not reproduce, modify, distribute, sell, or commercially exploit Wasatch Comic Con intellectual property without prior written permission.

Third-party trademarks, characters, comic properties, logos, artwork, and other intellectual property displayed at the Event belong to their respective owners.

Wasatch Comic Con does not claim ownership of intellectual property belonging to its guests, artists, vendors, sponsors, or attendees.

15. User-Submitted Content

If you submit photographs, artwork, comments, testimonials, applications, social media content, or other materials to Wasatch Comic Con, you represent that you have the necessary rights and permissions to submit the material.

You retain ownership of your original content unless otherwise agreed.

By submitting content for use by Wasatch Comic Con, you grant Wasatch Comic Con a non-exclusive, royalty-free license to use, reproduce, display, publish, and distribute that content for legitimate promotional, informational, archival, or Event-related purposes.

We will not intentionally represent your submitted content as being owned by Wasatch Comic Con when it is not.

16. Third-Party Websites and Services

The Website may contain links to third-party websites, social media platforms, payment providers, vendors, sponsors, or other services.

Wasatch Comic Con does not control third-party websites or services and is not responsible for their content, availability, security, or privacy practices.

Your use of third-party services is governed by the terms and policies of those third parties.

17. Disclaimers

The Website and its content are provided on an “as is” and “as available” basis to the extent permitted by law.

Wasatch Comic Con does not guarantee that:

  • The Website will always be available;

  • Website content will always be accurate or current;

  • The Website will be free of errors, interruptions, or harmful components;

  • Event information will remain unchanged;

  • A particular guest, vendor, sponsor, panel, activity, or program will appear at the Event.

We make reasonable efforts to provide accurate information but reserve the right to correct errors and update information at any time.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Wasatch Comic Con, The Nerd Store, their organizers, officers, employees, volunteers, contractors, agents, sponsors, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to:

  • Your use of the Website;

  • Your attendance at or participation in the Event;

  • Your inability to attend or participate;

  • Lost, stolen, or damaged property;

  • Actions of other attendees, vendors, guests, or third parties;

  • Changes to the Event;

  • Third-party websites or services.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

19. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Wasatch Comic Con, The Nerd Store, and their respective organizers, employees, volunteers, agents, contractors, and representatives from claims, liabilities, damages, losses, costs, and expenses arising from:

  • Your violation of these Terms;

  • Your violation of applicable laws or regulations;

  • Your conduct at the Event;

  • Your infringement of another person's intellectual property, privacy, publicity, or other rights;

  • Your actions or omissions that cause injury or damage to another person or property.

20. Accessibility

Wasatch Comic Con strives to provide an accessible and welcoming experience for attendees and participants.

If you require an accommodation or have an accessibility-related concern, please contact us in advance whenever possible so that we can discuss reasonable accommodations.

Venue policies and physical limitations may affect the accommodations that can be provided.

21. Privacy

Your use of the Website and submission of personal information is also governed by our Privacy Policy.

The Privacy Policy explains how Wasatch Comic Con collects, uses, stores, and protects personal information.

22. Children and Minors

Wasatch Comic Con is a family-friendly event; however, parents and legal guardians are responsible for supervising minors in their care.

Parents and guardians should review Event rules, venue requirements, and applicable policies with minors before attending.

Wasatch Comic Con is not responsible for supervising children or minors.

23. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles, except where applicable law requires otherwise.

To the extent permitted by law, disputes relating to these Terms or the Website shall be brought in a court of competent jurisdiction in Utah.

24. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

25. No Waiver

A failure by Wasatch Comic Con to enforce any provision of these Terms does not constitute a waiver of its right to enforce that provision in the future.

26. Entire Agreement

27. Changes to These Terms

Wasatch Comic Con may update these Terms from time to time.
